Terms of service

Last updated 14 October 2026

1. The service

Maps by DeltaBreen ("the service") serves map tiles, fonts, sprites, map styles, static map images, search (geocoding), elevation and directions answers (routes, distance tables and travel-time areas), and the data layers and icons you upload, to websites and applications that present a valid key or token, and provides a designer for those styles, a dashboard, an account API and a connector for AI assistants. These terms are a contract between you and DeltaBreen Limited (the operator of Maps by DeltaBreen), a company registered in Ireland with company number 826627 and VAT number IE4835019QH, of Gorey, Co. Wexford, Ireland ("we", "us"). By creating an account or using a key you accept them, and the dashboard asks you to confirm that when you first sign in, and again if they change in a way you need to agree to.

2. Plans and map loads

Each plan includes a number of map loads per calendar month. A map load is counted each time a page or an app starts showing a map. Everything that map then loads while the page or app stays open, for up to 24 hours, is part of the same load, and a map shown in another browser is a load of its own, so each visitor needs their own token. On the Free plan we have measures in place that stop a token shared between visitors; on a paid plan we will contact you. Raster tiles requested with a map key in the tile address count as map loads too, one load for every 50 tiles, or part of 50, in a calendar month. Past the allowance you receive, in order, banked loads (a fifth of the previous month's unused allowance, accumulating to at most half an allowance), a surge pool of half an allowance per calendar quarter, and any top-up loads you bought. Static map images and searches have their own monthly allowances and follow the same steps, each with its own top-ups; a search is an address or business search, a reverse lookup, an elevation request, a route or a travel-time area, and a distance table counts one search for each pair it answers. Top-ups are prepaid, bought for one of these when you buy them, do not expire while your account exists, end when the account is closed and are not refundable once used. When all of those are used, a paid plan keeps working while we contact you about the right plan, and we normally stop new tokens on a paid plan only after we have been in touch with you, subject to fair use below; on the Free plan new tokens are refused until the month ends, you buy a top-up or the plan is upgraded. Tokens already issued keep working until they expire. We never charge for use beyond a plan or a top-up you chose to buy. This does not cover deliberate abuse; see fair use below. Allowances, caps and features per plan are listed on the pricing page and may change with notice; a change that reduces your plan applies from the next billing period. Map data, geocoding and place results come from third parties (see section 8), routes and travel times are worked out from that map data at typical speeds with no live traffic, and all of them are provided for general use; they may be incomplete, out of date or wrong, and must not be relied on where an error could cause harm, such as navigation, emergency, legal or safety-critical use.

Fair use. On a paid plan, use past your allowance keeps working within fair use while we get in touch; what is fair use is at our reasonable discretion. We always reserve the right to limit, pause or refuse access, on any plan and without notice where needed, if use threatens the stability or security of the service or of other customers' maps, or runs up costs far beyond what the plan is priced for. Ordinary use past your plan is never charged. Deliberate abuse or intentional misuse of the service, such as handing one token to many visitors or working around limits or allowances, is not ordinary use: we may stop it at once and recover from you the costs it caused us.

3. Billing

Paid plans and top-ups are sold by Paddle, our merchant of record; plans monthly or yearly in advance and top-ups once, VAT included where Paddle collects it. Paddle's terms apply to the purchase. Prices are exclusive of any other taxes, duties or levies that apply to you, which are your responsibility. A change of plan takes effect immediately and Paddle prorates it: a larger plan charges the difference for the rest of the period, and a smaller plan credits the difference towards your next bills, while the month's allowances stay those of the larger plan until the month ends. A cancellation takes effect at the end of the paid period, and nothing you created is removed when a plan ends. Refunds follow Paddle's policy and the law where you are, as set out in the refund policy. If a payment fails or is reversed, or you raise a chargeback instead of requesting a refund, we may suspend or downgrade the account until the amount is settled, without affecting the no-overage promise.

4. Keys and your account

Accounts are opened with an email address you control. You are responsible for everything done with your keys: keep secret keys on servers, list only your own origins on publishable keys, and rotate a key you believe has leaked. Team workspaces are administered by their owner; members act under the owner's plan. Keep your contact address current so we can reach you about your account.

5. Acceptable use

You may not use the service to build something unlawful where you or your users are; to probe, overload or interfere with the service; to circumvent origin restrictions, rate limits or allowances; to scrape or bulk-download tiles for redistribution; or to present the map data as your own without the credits the plan requires. Map data is © OpenStreetMap contributors under the ODbL and the OpenStreetMap credit must remain visible on every map. We may suspend accounts and keys that break these rules, and we will comply with lawful orders.

6. Your content and our data

Styles you design are yours: plain MapLibre style JSON you may export and use elsewhere at any time. We may serve published versions for as long as your account exists so that sites referencing them keep working. Data layers and icons you upload are yours too. You confirm that you have the right to upload them and to have them shown on your maps, and that they are lawful; you give us the licence needed to store, convert and serve them for you while your account exists. We do not review uploads before they are served. We may remove or disable content that is unlawful or breaks these terms, and when we do we tell you why and how to contest it. Tiles, fonts and sprites are licensed to you for use through the service, not for copying.

Reporting illegal content. Anyone can report content hosted on the service that they believe is illegal, such as a data layer, an icon or a style, by email to [email protected]. Please say where it appears (a web address, or the map it is shown on), why you believe it is illegal, your name and email address, and that you believe in good faith that the report is accurate and complete. We confirm that we have it, a person reviews it promptly and with care, and we tell you what we decided and how to contest it; when we remove or restrict content we tell its owner why and how to contest it. We tell the authorities when content suggests a criminal offence that threatens someone's life or safety. Our point of contact for users and for the authorities of the EU Member States under the EU Digital Services Act is the same address, in English.

7. Address data from public registers

House numbers in search and reverse results may come from national and local address registers, gathered by the Overture Maps Foundation and each published under its own licence or terms. Such a result says so (source overture, with the register in metadata.dataset), and every register, with the credit and any conditions its terms set, is listed at /api/v1/sources/addresses; where you show those results you must give that credit and keep those conditions. In particular, addresses in Australia come from G-NAF (© Geoscape Australia, licensed by the Commonwealth of Australia under the Open G-NAF End User Licence Agreement) and must not be used to generate or compile addresses for sending mail unless you have verified each such address against a secondary source; and addresses in Canada are adapted from Statistics Canada's National Address Register, must not be presented as endorsed by Statistics Canada and must not be used to identify individuals.

8. Warranties and third-party data

The service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties, express or implied, and disclaim the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, or that the map data, tiles, geocoding, place results, routes or travel times will be accurate, complete or current. Map data is © OpenStreetMap contributors under the ODbL and other data comes from third-party sources (business listings from Foursquare Open Source Places under the Apache License 2.0, administrative areas, and house numbers from public registers, through the Overture Maps Foundation, landmarks from Wikidata, their photos from Wikimedia Commons each under its own licence, elevation from public terrain data); it is licensed to you as-is and we are not responsible for its content. Where a result comes with a credit or licence (a search answer's attribution, a landmark photo's image_credit and image_license, an elevation answer's credits), you must show it wherever you show that result. This section does not exclude any warranty or right that the law does not allow us to exclude, including the statutory rights of consumers.

9. Limitation of liability

To the extent the law allows: we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill, or business, however caused; we are not liable for anything arising from your content, your keys, your end users, third-party data or services, or events outside our reasonable control; and our total aggregate liability to you for all claims in any twelve-month period is limited to the greater of the amount you paid us for the service in that period and €100. These limits apply to any theory of liability and even if a remedy fails its essential purpose. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under a consumer's non-excludable statutory rights.

10. Indemnity

You will defend, indemnify and hold harmless DeltaBreen Limited and its people from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of the service, your content or styles, your keys, the data or claims of your end users, or your breach of these terms or of any law or third-party right. We will tell you promptly of a claim, let you control its defence for matters that are your responsibility, and cooperate reasonably; you may not settle anything that imposes an obligation on us without our consent. This does not apply to the extent a loss is caused by our own breach or by matters the law does not allow to be shifted, and consumers are only liable to the extent the law provides.

11. Availability and events outside our control

We run the service with care but without a guaranteed uptime unless an Enterprise agreement says otherwise, and we may perform maintenance, and change, suspend or withdraw features, on reasonable notice where practical. We are not liable for any failure or delay caused by events outside our reasonable control, including network or hosting failures, third-party providers, attacks, outages, acts of government, or force majeure.

12. Changes and termination

We may change these terms with 30 days' notice by email; continued use after that is acceptance, and if you do not accept a change you may close your account. You may delete your account at any time under Settings, Delete account; a paid plan is then cancelled and the unused part of its period refunded. We may suspend access at once to protect the service, other users or the law, and we may close accounts that break these terms, or with 30 days' notice for any other reason, refunding any unused paid period. If we ever close the service as a whole, we will tell you by email at least six months before, and refund any part of a paid period that runs past the closing date. Sections that by their nature should survive — including warranties, liability, indemnity, our data licence and law — survive termination.

13. General

These terms, the pricing page and, where it applies, the data processing agreement, are the entire agreement between us about the service and replace any earlier understanding. We may assign or transfer them, for example in a reorganisation or sale of the business; you may not assign yours without our consent. If any part is unenforceable, the rest stays in force. A delay in enforcing a term is not a waiver of it. There are no third-party beneficiaries. Notices to you are sent to your account email; notices to us go to the address below.

14. Law

These terms are governed by the law of Ireland and the Irish courts have jurisdiction, without prejudice to the rights consumers have where they live. Contact: [email protected].
